CAN I HIRE AN INTERNATIONAL INTERN/TRAINEE?

HOST EMPLOYER GUIDANCE: ELIGIBILITY REQUIREMENTS TO HIRE A J-1 INTERN/TRAINEE

Infinity Abroad assists qualified candidates in Malaysia & Singapore in obtaining visa sponsorship for the J-1 Internship & Training USA program.

Employers looking to host J-1 intern or trainees must meet eligibility requirements set by the U.S. Department of State.

Here is a quick summary:

  1. J-1 internships & training programs are intended to provide work-based training in an eligible field, enabling candidates to enhance their skills and prepare for their future careers. These programs may NOT be used for ordinary employment purposes or to fill a labor need.
  2. Employers must comply with federal, state and local labor and occupational health and safety laws, including compensation for interns.
  3. Candidates hired for more than 6 months must be paid at least the state minimum wage.
  4. Provide full-time (32-45hrs per week) professional, office-based training with no more than 20% clerical or basic work. Home-based businesses are not permitted.
  5. Develop an internship or training program, as outlined in the DS-7002 Training/Internship Placement Plan, that allows candidates to obtain skills, knowledge, and competencies through structured and guided training provided by U.S. employees who are qualified in the candidates’ fields.
  6. There must be at least 5 full-time employees to 1 J-1 intern/trainee to ensure adequate supervision and training.
  7. Be in business and operational for at least 6 months.
  8. Have an English-language website and a company-based email addresses.
  9. Consent to a site visit by the candidate’s visa sponsor, if required. This rule is mandatory for businesses with fewer than 25 full-time employees, and less than $3 million in revenue.
  10. Agree to provide mandatory evaluations and to notify the applicant’s program sponsor in case of any changes to the applicant’s program or emergencies.

REQUIRED DOCUMENTS

Employers must provide the following paperwork/documentation:

  1. Proof of a workers’ compensation policy or equivalent insurance that covers J-1 participants (or proof of exemption).
  2. Either a DUNS number or copy of your business registration.
  3. A Federal Identification Number.

We’re now off to an amazing Summer Work & Travel experience in the USA!

A heartfelt congratulations to Seng Kai, Matthew, Dominic & Khai Kee who got their visas approved earlier this month!

Seng Kai & his friends are avid followers of the Work & Travel USA program. When the pandemic hit last year, they had to put off their plans, but remained resilient and determined to join the program once it was possible to do so.

Once the Summer 2021 intake opened, Seng Kai and Matthew signed up in a heartbeat. A month later, they secured job offers from Ober Gatlinburg in Gatlinburg, Tennessee. Following his success, his friends Dominic & Khai Kee jumped on the bandwagon too. Both interviewed successfully and received job offers from YMCA of the Rockies in Estes Park, Colorado.

With full support from the Infinity Abroad team, a lengthy process followed in getting their application paperwork in order, arranging overseas travel approval and in April, once the J-1 visa suspension was lifted, Seng Kai and his friends attended visa interview appointments at the U.S. Consulate in Kuala Lumpur. Their visas were approved on the spot. With this final chip in place, they are now all set and flying off soon to start their program in the USA!

Working and living overseas can be daunting, and takes preparation, resourcefulness and considerable undertaking, even without the pandemic hovering over us. Kudos to Seng Kai, Matthew, Dominic & Khai Kee who, through their commitment and drive, have set the example for current and future Malaysian students to seize the opportunity for an meaningful cultural exchange experience in this post-COVID era.
